中國（河南）自由貿(mào)易試驗(yàn)區(qū)

一、實(shí)施范圍

2016年8月31日，國務(wù)院正式批復(fù)設(shè)立中國（河南）自由貿(mào)易試驗(yàn)區(qū)。自貿(mào)試驗(yàn)區(qū)地理位置及范圍：河南自貿(mào)試驗(yàn)區(qū)的實(shí)施范圍共119.77平方公里，涵蓋鄭州片區(qū)73.17平方公里，開封片區(qū)19.94平方公里，洛陽片區(qū)26.66平方公里。

二、河南自貿(mào)試驗(yàn)區(qū)概況

（一）戰(zhàn)略定位

以制度創(chuàng)新為核心，以可復(fù)制推廣為基本要求，加快建設(shè)貫徹南北、連接?xùn)|西的現(xiàn)代立體交通體系和現(xiàn)代物流體系，將自貿(mào)試驗(yàn)區(qū)建設(shè)成為服務(wù)于“一帶一路”建設(shè)的現(xiàn)代綜合交通樞紐、全面改革開放試驗(yàn)田和內(nèi)陸開放型經(jīng)濟(jì)示范區(qū)。

（二）發(fā)展目標(biāo)

經(jīng)過三至五年改革探索，形成與國際投資貿(mào)易通行規(guī)則相銜接的制度創(chuàng)新體系，營造法制化國際化便利化的營商環(huán)境，努力將自貿(mào)試驗(yàn)區(qū)建設(shè)成為投資貿(mào)易便利、高端產(chǎn)業(yè)集聚、交通物流通達(dá)、監(jiān)管高效便利、輻射帶動作用突出的高水平高標(biāo)準(zhǔn)自由貿(mào)易園區(qū)，引領(lǐng)內(nèi)陸經(jīng)濟(jì)轉(zhuǎn)型發(fā)展，推動構(gòu)建全方位對外開放新格局。

（三）區(qū)位布局

在區(qū)位布局上，鄭州片區(qū)重點(diǎn)發(fā)展智能終端、高端裝備及汽車制造、生物醫(yī)藥等先進(jìn)制造業(yè)以及現(xiàn)代物流、國際商貿(mào)、跨境電商、現(xiàn)代金融服務(wù)、服務(wù)外包、創(chuàng)意設(shè)計(jì)、商務(wù)會展、動漫游戲等現(xiàn)代服務(wù)業(yè)，在促進(jìn)交通物流融合發(fā)展和投資貿(mào)易便利化方面推進(jìn)體制機(jī)制創(chuàng)新，打造多式聯(lián)運(yùn)國際性物流中心，發(fā)揮服務(wù)“一帶一路”建設(shè)的現(xiàn)代綜合交通樞紐作用；

開封片區(qū)重點(diǎn)發(fā)展服務(wù)外包、醫(yī)療旅游、創(chuàng)意設(shè)計(jì)、文化傳媒、文化金融、藝術(shù)品交易、現(xiàn)代物流等服務(wù)業(yè)，提升裝備制造、農(nóng)副產(chǎn)品加工國際合作及貿(mào)易能力，構(gòu)建國際文化貿(mào)易和人文旅游合作平臺，打造服務(wù)貿(mào)易創(chuàng)新發(fā)展區(qū)和文創(chuàng)產(chǎn)業(yè)對外開放先行區(qū)，促進(jìn)國際文化旅游融合發(fā)展；

洛陽片區(qū)重點(diǎn)發(fā)展裝備制造、機(jī)器人、新材料等高端制造業(yè)以及研發(fā)設(shè)計(jì)、電子商務(wù)、服務(wù)外包、國際文化旅游、文化創(chuàng)意、文化貿(mào)易、文化展示等現(xiàn)代服務(wù)業(yè)，提升裝備制造業(yè)轉(zhuǎn)型升級能力和國際產(chǎn)能合作能力，打造國際智能制造合作示范區(qū)，推進(jìn)華夏歷史文明重要傳承區(qū)建設(shè)。

（四）主要試點(diǎn)任務(wù)和措施

在主要任務(wù)措施上，重點(diǎn)提出了政府職能轉(zhuǎn)變、投資、貿(mào)易、金融、增強(qiáng)服務(wù)“一帶一路”建設(shè)的交通物流樞紐功能等5個(gè)方面的試點(diǎn)內(nèi)容。

一是加快政府職能轉(zhuǎn)變。深化行政管理體制改革，進(jìn)一步推進(jìn)簡政放權(quán)、放管結(jié)合、優(yōu)化服務(wù)改革，完善市場監(jiān)管機(jī)制，推動政府管理由注重事前審批向注重事中事后監(jiān)管轉(zhuǎn)變。提高行政服務(wù)效能，完善行政部門權(quán)力清單和責(zé)任清單，營造法治化國際化便利化營商環(huán)境。

二是擴(kuò)大投資領(lǐng)域開放。提升利用外資水平，對外商投資實(shí)行準(zhǔn)入前國民待遇加負(fù)面清單管理制度，著力構(gòu)建與負(fù)面清單管理方式相適應(yīng)的事中事后監(jiān)管制度。進(jìn)一步減少或取消外商投資準(zhǔn)入限制，提高開放度和透明度。構(gòu)建對外投資合作服務(wù)平臺，改革境外投資管理方式，支持企業(yè)境外投資。

三是推動貿(mào)易轉(zhuǎn)型升級。圍繞統(tǒng)籌內(nèi)外貿(mào)一體化發(fā)展、推進(jìn)貿(mào)易方式轉(zhuǎn)型升級和營造規(guī)范高效的貿(mào)易便利化環(huán)境，完善外貿(mào)發(fā)展載體，拓展新型貿(mào)易方式，積極培育貿(mào)易新型業(yè)態(tài)和功能，形成以技術(shù)、標(biāo)準(zhǔn)、品牌、質(zhì)量、服務(wù)為核心的競爭新優(yōu)勢。創(chuàng)新通關(guān)監(jiān)管機(jī)制，提高通關(guān)通檢效率，切實(shí)嚴(yán)密防范質(zhì)量安全風(fēng)險(xiǎn)。

四是深化金融領(lǐng)域開放創(chuàng)新。擴(kuò)大金融對內(nèi)對外開放，拓展金融服務(wù)功能，推動跨境投融資創(chuàng)新，建立健全金融風(fēng)險(xiǎn)防控體系。結(jié)合跨境電子商務(wù)、多式聯(lián)運(yùn)發(fā)展需要，借鑒現(xiàn)有自貿(mào)試驗(yàn)區(qū)經(jīng)驗(yàn)，重點(diǎn)在引進(jìn)境外金融機(jī)構(gòu)、擴(kuò)大跨境投融資等方面推動改革創(chuàng)新。

五是增強(qiáng)服務(wù)“一帶一路”建設(shè)的交通物流樞紐功能。圍繞完善交通物流體系、促進(jìn)多式聯(lián)運(yùn)發(fā)展和服務(wù)“一帶一路”建設(shè)等關(guān)鍵環(huán)節(jié)，暢通國際交通物流通道，完善國內(nèi)陸空集疏網(wǎng)絡(luò)，開展多式聯(lián)運(yùn)先行示范，擴(kuò)大航空服務(wù)開放，推進(jìn)內(nèi)陸口岸經(jīng)濟(jì)創(chuàng)新發(fā)展，創(chuàng)新國際醫(yī)療旅游產(chǎn)業(yè)融合發(fā)展。建立健全與“一帶一路”沿線重點(diǎn)國家的合作機(jī)制，培育合作交流新優(yōu)勢。

I.Implementation Area:

The State Council had been executed Henan Pilot Free Trade Zone in 31th,August 2016. Henan Pilot Free Trade Zone covers an area of 119.77 square kilometers, including 73.17 square kilometers in Zhengzhou, 19.94 square kilometers in Kaifeng and 26.66 square kilometers in Luoyang.

II. Overview of Henan Pilot Free Trade Zone
(1) Strategic positioning

We should follow the institutional innovation and the adaptable and propagable approaches, advance the building of a modern multimodal traffic and logistics network linking up the north and the south and connecting the east and the west, and build Henan Pilot Free Trade Zone into a modern comprehensive transportation hub, an all-round reform and opening-up pilot area and an inland open economy demonstration zone serving “The Belt and Road” initiative.

(2) Development goal

In 3-5 years, we will make great efforts to form an innovative system meeting international general rules for investment and trade, shape a law-based, international, convenient business environment, and build a high-level and high-standard free trade zone which enjoys facilitated investment and trade, agglomerated high-end industries, convenient transportation and logistics, efficient supervision and remarkable radiation and driving effects, advancing the transformation and development of inland economy, as well as the building of new opening-up pattern in all aspects.

(3) Location and layout

Zhengzhou Area focuses on the development of modern manufacturing, such as intelligent terminal, advanced equipment, automobile making and bio-pharmaceuticals, and modern services, such as modern logistics, international business, cross-border e-commerce, modern finance, service outsourcing, creative design, commerce exhibition and cartoon & game. Meanwhile, Zhengzhou Area will push forward system and mechanism reform to promote the coordinated development of transportation and logistics and make investment and trade here more convenient, build an international multimodal transport and logistics center, and play its role of modern comprehensive transportation hub serving “the Belt and Road” Initiative;

Kaifeng Area gives priority to the development of service outsourcing, medical tourism, creative design, cultural media, cultural finance, artwork trading and modern logistics. Meanwhile, Kaifeng Area will deepen the international cooperation and trade in equipment manufacturing and agricultural and sideline products processing, build a platform for international cultural trade and tourism, and create a service & trade innovation area and a cultural opening pilot area to promote the integrated development of international culture and tourism.

Luoyang Area concentrates on the development of advanced manufacturing, such as equipment manufacturing, robots and new materials, and modern services, such as R&D and design, e-commerce, service outsourcing, international cultural tourism, cultural creativity, cultural trade and cultural presentation. Meanwhile, Luoyang Area will increase the abilities in transformation and upgrading of equipment manufacturing and in international capacity cooperation, build an international intelligent manufacturing demonstration area, and push forward the building of inheritance area of Huaxia Civilization.

(4) Main pilot tasks and measures

As for main tasks and measures, five aspects such as transformation of government functions, investment, trade, finance and transportation & logistics hub serving “the Belt and Road” Initiative are put forward.

Firstly, speed up the transformation of government functions. Deepen the reform of the administrative system to streamline administration, delegate more powers, improve regulation, and provide better services; improve the market supervision mechanism, and promote the management focus from prior approval to operational and post-operational oversight over business. Increase the efficiency of administrative service, release the lists of all powers and responsibilities of administrative departments, and create law-based, international and convenient business environment.

Secondly, deepen the opening in investment. Make better use of overseas investment, put into force across the board the management system for pre-establishment national treatment plus a negative list, and build the operational and post-operational oversight over business that are compatible with the negative list management. Further reduce or cancel the admission restriction on foreign investment to increase the openness and transparency. Build a platform for cooperation in foreign investment, reform the management mode of investment abroad, and support investment of enterprises in foreign countries.

Thirdly, promote trade transformation and upgrading. Pursue the integrated development of domestic and foreign trade, advance the transformation and upgrading of trade modes, and shape a standardized and efficient trade facilitation environment. Improve the carrier of foreign trade development, create new trade modes and actively cultivate new forms and functions of business to form a new competitive advantage which takes technology, standard, brand, quality and service as the core. Create new supervision and management mechanism of customs clearance to improve the efficiency of customs clearance and inspection clearance and to avoid the quality and safety risks.

Fourthly, deepen the opening and innovation in the finance. Enlarge the opening up in the finance both internally and externally, expand functions of financial service, promote the innovation of cross-border financing and investment, and establish and improve the financial risk prevention and control system. Learn from the experience of the existing free trade zones based on the development needs of cross-border e-commerce and multimodal transport. Place priority on the reform and innovation in the introduction of foreign financial institutions and expansion of cross-border investment and financing.

Fifthly, enhance functions of the transportation & logistics hub serving “the Belt and Road” Initiative. Improve the transportation & logistics system, advance the development of multimodal transport, and carry out key procedures to serve “the Belt and Road” Initiative. Smooth the international transportation and logistics channels, improve the domestic land and air cluster network, pilot the multimodal transport, expand the openness of aviation service, promote economic innovation and development of inland ports, and promote the integrative development of international medical and tourism industry. Establish and improve the cooperation mechanism with key countries along the “the Belt and Road” routes, and create new strengths for cooperation and exchange.
