前期物業(yè)服務(wù)合同示范文本
使 用 說 明
1、本合同為示范文本,適用于住宅以及同一物業(yè)管理區(qū)域內(nèi)非住宅的物業(yè)管理。合同雙方當(dāng)事人在簽約之前應(yīng)當(dāng)仔細(xì)閱讀本示范文本的內(nèi)容。
2、本示范文本所稱的甲方為物業(yè)建設(shè)單位,乙方為物業(yè)建設(shè)單位通過招投標(biāo)或協(xié)議選聘方式選聘的物業(yè)服務(wù)企業(yè)。經(jīng)雙方當(dāng)事人協(xié)商確定,可以對(duì)本示范文本的條款內(nèi)容(包括選擇內(nèi)容、填寫空格部位的內(nèi)容)進(jìn)行選擇、修改、增補(bǔ)或刪減。
3、本示范文本的服務(wù)期限應(yīng)根據(jù)《物業(yè)管理?xiàng)l例》第二十六條“前期物業(yè)服務(wù)合同可以約定期限;但是,期限未滿、業(yè)主委員會(huì)與物業(yè)服務(wù)企業(yè)簽訂的物業(yè)服務(wù)合同生效的,前期物業(yè)服務(wù)合同終止”的規(guī)定確定。
4、根據(jù)《上海市住宅物業(yè)管理規(guī)定》第三十七條的相關(guān)規(guī)定,本合同為甲方與物業(yè)買受人簽訂的房屋銷售合同的組成部分。物業(yè)買受人應(yīng)當(dāng)仔細(xì)閱讀本示范文本的內(nèi)容,對(duì)條款及專業(yè)用詞理解不一致的,可向建設(shè)單位和市、區(qū)房屋行政管理部門咨詢。

甲、乙雙方在自愿、平等、協(xié)商一致的基礎(chǔ)上,就 (物業(yè)名稱)的物業(yè)管理服務(wù)事宜,訂立本合同。

第二條 本合同為期 年,自 年 月 日起至 年 月 日止。若合同期限未滿,業(yè)主大會(huì)與物業(yè)服務(wù)企業(yè)簽訂的物業(yè)服務(wù)合同生效的,本合同終止。
本合同期限屆滿后,全體業(yè)主沒有作出續(xù)聘或者另聘物業(yè)服務(wù)企業(yè)決定,乙方按照本合同繼續(xù)提供服務(wù)的,本合同中甲方、業(yè)主、乙方各自的權(quán)利義務(wù)延續(xù)。在合同權(quán)利義務(wù)延續(xù)期間,任何一方提出終止合同的,應(yīng)當(dāng)提前三個(gè)月書面告知對(duì)方。
第三條 乙方根據(jù)下述約定按照建筑面積向業(yè)主收取物業(yè)服務(wù)費(fèi)。

第四條 本合同履行過程中,物業(yè)服務(wù)費(fèi)標(biāo)準(zhǔn)按照下列第 種方式按簽約年度調(diào)整:

第五條 業(yè)主的物業(yè)服務(wù)費(fèi)用應(yīng)按 (年/季/月)交納。

自本合同生效之日的當(dāng)月至出售物業(yè)交付之日的當(dāng)月發(fā)生的物業(yè)服務(wù)費(fèi)用,由甲方承擔(dān);出售物業(yè)交付之日的次月至本合同終止之日的物業(yè)服務(wù)費(fèi)用,由物業(yè)買受人按照本合同的約定承擔(dān);房屋銷售合同未約定的,由甲方承擔(dān)。已竣工但尚未出售的物業(yè)以及甲方未交付給業(yè)主的物業(yè),由甲方依照本合同約定的標(biāo)準(zhǔn)向乙方交納物業(yè)服務(wù)費(fèi)。
業(yè)主延期支付物業(yè)服務(wù)費(fèi)用、停車費(fèi)或者本合同約定的其它應(yīng)繳費(fèi)用的,按照每日千分之 計(jì)違約金。
業(yè)主拒繳物業(yè)服務(wù)費(fèi)的,雙方約定按照以下第 、 、 種方法處理:

(二)酬金制:乙方在本合同第三條約定預(yù)收的物業(yè)服務(wù)資金中按下述第____種方式提取酬金,其余全部用于物業(yè)服務(wù)合同約定的支出,結(jié)余或者不足均由業(yè)主享有或者承擔(dān):

第八條 采用酬金制結(jié)算方式的,物業(yè)服務(wù)資金年終結(jié)余或不足的處理方式:
(一)年度結(jié)算結(jié)余部分,按以下第____種方式處理:
1、轉(zhuǎn)入下年度繼續(xù)使用;

第九條 物業(yè)專有部分的自用部位、自用設(shè)備損壞時(shí),業(yè)主、物業(yè)使用人可以向乙方報(bào)修,也可以自行維修。經(jīng)報(bào)修由乙方維修的,維修費(fèi)用由業(yè)主、物業(yè)使用人承擔(dān)。
第十條 甲方按規(guī)定向乙方提供位于 路 號(hào) 室 平方米建筑面積作為物業(yè)管理辦公用房,在合同履行期間供乙方無償使用,但不得改變其用途。
第十一條 乙方提供的前期物業(yè)管理服務(wù)內(nèi)容和標(biāo)準(zhǔn)應(yīng)符合下列約定:
(一)物業(yè)共用部位的維護(hù)、物業(yè)共用設(shè)施設(shè)備的日常運(yùn)行和維護(hù),詳見附件三
(二)物業(yè)公共區(qū)域綠化養(yǎng)護(hù)服務(wù),詳見附件四;
(三)物業(yè)公共區(qū)域的清潔衛(wèi)生服務(wù),詳見附件五;
(四)物業(yè)公共區(qū)域的秩序維護(hù)服務(wù),詳見附件六;
(五)物業(yè)使用禁止性行為的管理,詳見附件七;
(六)物業(yè)其他公共事務(wù)的管理服務(wù),詳見附件八;
第十二條 甲方將物業(yè)交付業(yè)主前,應(yīng)會(huì)同乙方對(duì)物業(yè)共用部位、共用設(shè)施設(shè)備進(jìn)行查驗(yàn),并按規(guī)定向乙方移交物業(yè)管理所必需的相關(guān)資料。
甲、乙雙方辦理物業(yè)查驗(yàn)、移交手續(xù),對(duì)查驗(yàn)、移交中發(fā)現(xiàn)的問題及相應(yīng)解決辦法應(yīng)采用書面方式予以確認(rèn),具體內(nèi)容詳見附件九。
第十三條 停車場(chǎng)收費(fèi)分別采取以下方式:
(一)停車場(chǎng)屬于全體業(yè)主共有的,車位使用人應(yīng)向乙方交納停車位租賃費(fèi),乙方可提取停車位物業(yè)服務(wù)費(fèi),停車位物業(yè)服務(wù)費(fèi)可在乙方收取的停車位租賃費(fèi)中提取,具體標(biāo)準(zhǔn)如下:
1、停車位租賃費(fèi)
露天機(jī)動(dòng)車車位 元/個(gè)·月、車庫機(jī)動(dòng)車車位 元/個(gè)·月、

停車位租賃費(fèi)扣除停車位物業(yè)服務(wù)費(fèi)后的收益歸全體業(yè)主共有,并按本合同第十八條第四款約定公布。
(二)停車場(chǎng)屬于甲方所有、委托乙方管理的,業(yè)主和物業(yè)使用人有優(yōu)先使用權(quán),車位使用人應(yīng)向甲方交納停車位租賃費(fèi):乙方應(yīng)向甲方收取停車位物業(yè)服務(wù)費(fèi),具體標(biāo)準(zhǔn)如下:
1、停車位租賃費(fèi):
露天機(jī)動(dòng)車位 元/個(gè)·月、車庫機(jī)動(dòng)車位 元/個(gè)·月
2、停車位物業(yè)服務(wù)費(fèi):

甲方委托乙方代為收取停車位租賃費(fèi)的,應(yīng)按照 元/個(gè)·月的標(biāo)準(zhǔn)向乙方支付租賃管理服務(wù)費(fèi)。
(三)停車場(chǎng)車位所有權(quán)或使用權(quán)由業(yè)主購置的,車位使用人應(yīng)按露天車位 元/個(gè)·月、車庫車位 元/個(gè)·月的標(biāo)準(zhǔn)向乙方交納停車位物業(yè)服務(wù)費(fèi)。
停車位租賃費(fèi)、停車位物業(yè)服務(wù)費(fèi)、租賃管理服務(wù)費(fèi)的支付時(shí)間同本合同第五條的約定。
業(yè)主或物業(yè)使用人對(duì)車輛停放有保管要求的,與乙方另行約定。
第十四條 本物業(yè)管理區(qū)域內(nèi)全體業(yè)主共有的會(huì)所及相關(guān)設(shè)施委托乙方經(jīng)營管理,經(jīng)營管理收費(fèi)約定如下:
(一)健身房: ;

上述經(jīng)營管理收入按下列第 種方式約定分配:

本物業(yè)管理區(qū)域內(nèi)屬甲方所有的會(huì)所及相關(guān)設(shè)施,其經(jīng)營管理收費(fèi)由甲方與乙方或者業(yè)主、物業(yè)使用人另行約定。
第十五條 利用小區(qū)共有部分獲取的收入扣除管理成本后的收益,包括但不限于廣告收益、房屋租賃收益,歸全體業(yè)主所有,在小區(qū)業(yè)主委員會(huì)成立后移交,由小區(qū)業(yè)主大會(huì)進(jìn)行支配。
第十六條 業(yè)主應(yīng)當(dāng)按照下列規(guī)定籌集、使用和管理維修資金:
(一)業(yè)主應(yīng)當(dāng)按照規(guī)定交納專項(xiàng)維修資金;
(二)專項(xiàng)維修資金的賬務(wù)由 (乙方或代理記賬機(jī)構(gòu))代管;
(三)業(yè)主在轉(zhuǎn)讓其物業(yè)時(shí),其賬戶上的專項(xiàng)維修資金繼續(xù)用作物業(yè)的共用部位、共用設(shè)備設(shè)施的維修、更新和改造;
(四)按照政府規(guī)章及相關(guān)規(guī)定使用和管理專項(xiàng)維修資金。
第十七條 甲方相關(guān)的權(quán)利義務(wù):
(一)應(yīng)在其制定的《臨時(shí)管理規(guī)約》中向業(yè)主明示物業(yè)裝飾裝修管理要求等事項(xiàng);甲方未盡此義務(wù)而給乙方或業(yè)主、物業(yè)使用人造成損失的,應(yīng)承擔(dān)賠償責(zé)任;
(二)在物業(yè)銷售前,向業(yè)主明示物業(yè)服務(wù)收費(fèi)標(biāo)準(zhǔn)和停車位租賃費(fèi)等相關(guān)收費(fèi)標(biāo)準(zhǔn),督促業(yè)主按時(shí)交納物業(yè)服務(wù)費(fèi)用等相關(guān)費(fèi)用;對(duì)業(yè)主或物業(yè)使用人違反《臨時(shí)管理規(guī)約》的行為予以勸阻、制止;
(三)授權(quán)乙方對(duì)業(yè)主、物業(yè)使用人違反《臨時(shí)管理規(guī)約》的行為,依照《臨時(shí)管理規(guī)約》的約定進(jìn)行勸阻、制止;
(四)完善本物業(yè)管理區(qū)域內(nèi)的配套設(shè)施和配套工程,包括物業(yè)標(biāo)識(shí)系統(tǒng)、公共垃圾桶、垃圾中轉(zhuǎn)站、垃圾房等;
(五)審查和批準(zhǔn)物業(yè)管理方案、年度管理計(jì)劃、年度維修養(yǎng)護(hù)計(jì)劃、年度費(fèi)用概預(yù)算、決算報(bào)告,監(jiān)督、檢查乙方各項(xiàng)方案和計(jì)劃的實(shí)施;
(六) 。
第十八條 乙方相關(guān)的權(quán)利義務(wù):
(一)設(shè)立專門機(jī)構(gòu)負(fù)責(zé)本物業(yè)的日常管理工作,履行本合同;
(二)根據(jù)法律、法規(guī)的有關(guān)規(guī)定和本合同的約定,開展各項(xiàng)物業(yè)服務(wù)活動(dòng),但不得侵害業(yè)主、物業(yè)使用人及他人的合法權(quán)益,不得利用提供物業(yè)管理服務(wù)的便利獲取不當(dāng)利益;
(三)根據(jù)有關(guān)法律、法規(guī)的規(guī)定和本合同的約定,向業(yè)主或物業(yè)使用人收取物業(yè)服務(wù)費(fèi)用,通過合法有效的方式解決拖欠物業(yè)服務(wù)費(fèi)的問題;
(四)及時(shí)向業(yè)主公告本管理區(qū)域內(nèi)的重大物業(yè)服務(wù)事項(xiàng),每 個(gè)月公布一次專項(xiàng)維修資金和共有部分收益的收支賬目;
(五)結(jié)合本物業(yè)的實(shí)際情況,編制物業(yè)管理方案、年度管理計(jì)劃、年度維修養(yǎng)護(hù)計(jì)劃、年度費(fèi)用概預(yù)算和決算報(bào)告;
(六) 。
第十九條 在物業(yè)管理服務(wù)過程中發(fā)生下列事由,乙方不承擔(dān)責(zé)任。
(一)因不可抗力導(dǎo)致物業(yè)管理服務(wù)中斷的;
(二)乙方已履行本合同約定義務(wù),但因物業(yè)本身固有瑕疵造成損失的;
(三)因維修養(yǎng)護(hù)物業(yè)共用部位、共用設(shè)施設(shè)備需要且事先已告知業(yè)主和
物業(yè)使用人,暫時(shí)停水、停電、停止共用設(shè)施設(shè)備使用等造成損失的;
(四)因非乙方責(zé)任出現(xiàn)供水、供電、供氣、供熱、通訊、有線電視及其他共用設(shè)施設(shè)備運(yùn)行障礙造成損失的;
(五) ;

第二十條 甲方違反本合同約定義務(wù),致使乙方的管理服務(wù)無法達(dá)到本合同第十一條及附件十物業(yè)服務(wù)方案約定的服務(wù)內(nèi)容和標(biāo)準(zhǔn)的,由甲方賠償由此給業(yè)主和物業(yè)使用人造成的損失。
第二十一條 除前條規(guī)定情況外,乙方的管理服務(wù)達(dá)不到本合同第十一條及附件十物業(yè)服務(wù)方案約定的服務(wù)內(nèi)容和標(biāo)準(zhǔn)的,乙方承擔(dān)下列第 種方式的違約責(zé)任:
(一)以違約事項(xiàng)涉及并收取的服務(wù)費(fèi)為基數(shù)相應(yīng)減少物業(yè)服務(wù)費(fèi);
(二) 。
第二十二條 乙方違反本合同的約定,擅自提高收費(fèi)標(biāo)準(zhǔn)的,對(duì)超出標(biāo)準(zhǔn)的部分,業(yè)主有權(quán)拒絕支付;已經(jīng)支付的,業(yè)主有權(quán)要求乙方 倍返還。
